Streakwell is operated by Preston Smith ("Streakwell", "we", "us"). These Terms form an agreement between you and Preston Smith covering your use of the Streakwell website and application at streakwell.live (the "Service").

By creating an account or continuing to use the Service you agree to these Terms. If you are using Streakwell on behalf of an organisation, you confirm you have authority to bind that organisation. If you are using it as an individual, you confirm you are of legal age in your country.

Streakwell lets you record daily habits, build streaks, compare progress with friends you add, and — on a paid Pro plan — access unlimited habits, unlimited friends, a Pro badge and completion analytics. Free accounts are limited to 3 habits and 5 friends.

You must give accurate information and keep it current. You are responsible for keeping your login credentials confidential and for all activity that happens under your account. Tell us immediately if you suspect unauthorised access.

You must not:

• use the Service for anything unlawful, fraudulent or deceptive;
• send spam, harass other users, or abuse the friends and leaderboard features;
• infringe anyone's intellectual property or privacy rights;
• interfere with the security or integrity of the Service — including malware, probing, penetration testing without permission, scraping, or circumventing plan limits;
• resell, redistribute or reverse engineer the Service.

We grant you a limited, non-exclusive, non-transferable right to use the Service in line with the plan you have selected. We retain all ownership of the Service, its software, design and branding. You keep ownership of the habit data you enter; you grant us a limited licence to host and process it solely to provide the Service to you and to the friends you choose to share with under your privacy settings.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Pro subscriptions are billed in advance, monthly ($6) or yearly ($48), and renew automatically until cancelled. Billing, tax, currency, cancellation and refund mechanics are governed by Paddle's Buyer Terms. You can change or cancel your plan at any time from the Billing page in the app.

We work to keep Streakwell available and accurate, but we do not guarantee that the Service will be uninterrupted, timely, secure or error-free. Features may change or be withdrawn as the product evolves.

To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Our total aggregate liability is capped at the fees you paid in the 12 months before the claim. Nothing in these Terms excludes liability for fraud, death or personal injury caused by negligence, or anything else that cannot be excluded by law.

You agree to indemnify us against claims arising from content you submit, your unlawful use of the Service, or your breach of these Terms.

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may close your account at any time. When access ends, you may export your data on request within 30 days, after which we may delete it.

We may update these Terms as the Service changes. Material changes will be announced in the app or by email before they take effect.

These Terms are governed by the laws of the United States and the state in which Preston Smith resides, and the courts of that jurisdiction have exclusive jurisdiction over any dispute.

You may not assign these Terms without our consent; we may assign them in connection with a merger or acquisition. Neither party is liable for delays caused by events beyond their reasonable control. Questions? Contact us at support@streakwell.live.
